About giv

giv is a software platform made available to registered organisations as part of a software and web development service. It provides online giving infrastructure - giving pages, giving URLs, QR codes, and reporting tools - that organisations use to facilitate and manage online giving from their own community.

giv is not a financial service, payment platform, fundraising manager, or payment service provider, and does not operate as one. giv has no involvement in the collection, processing, holding, transfer, or settlement of any funds. All contributions pass directly between the giver and the organisation through the organisation's own independently managed payment processor account.

giv is provided under a software and web development service engagement: it is built, hosted, and maintained for Organisations to use in running their own giving programme.

Definitions

  • giv - the software platform described in these Terms, comprising the giving pages, giving URLs, QR codes, dashboard, and reporting tools made available to Organisations
  • Organisation - a registered entity that requires the service and agrees to use giv in accordance with these Terms and Conditions and the Privacy Policy
  • Giver - any individual who makes a contribution through an Organisation's giving page on giv
  • Giving Page - a hosted page, URL, or QR code within giv facilitating contributions made directly to an Organisation
  • Service Fee - the fee paid by Organisations for the usage of relevant services, including the use of the giv platform, along with any support and assistance provided in connection with the service. Fee may change with reasonable notice.
  • Payment Processor - the third-party payment service independently selected and utilized by the Organisation (e.g. Stripe or other supported processors)

Nature of giv

  • giv is a platform through which Organisations host their giving pages
  • giv provides reporting and record-keeping tools for Organisations to view their own giving data
  • giv does not manage, control, or administer any aspect of an Organisation's giving programme
  • Neither giv nor its developer acts as an agent, representative, trustee, or fiduciary of any Organisation or giver
  • Neither giv nor its developer provides financial, payment, fundraising, legal, or regulatory services of any kind

Organisation Terms

4.1 Onboarding & Approval

Organisations must apply for access to giv. Applications are reviewed and approved at our sole discretion, without obligation to give a reason for rejection.

4.2 Eligibility

To access giv, an Organisation must:

  • Be a legally registered entity or operate with lawful authority in its jurisdiction
  • Provide accurate, complete information and valid documentation
  • Agree to these Terms in full
  • Pay the applicable Service Fee

4.3 Account Responsibility

Organisations are solely responsible for:

  • The accuracy of information provided
  • Confidentiality of login credentials
  • All activity under their account, including by invited team members
  • Compliance with applicable laws in their jurisdiction
  • Keeping profile, contact, and payment processor details current

4.4 Giving Pages

Organisations are solely responsible for the content of their Giving Pages, the purpose for which contributions are solicited, and all communications with givers.

4.5 Payment Processor

Each Organisation independently selects and manages its own payment processor account. giv provides technical integration only; neither giv nor its developer is a party to any payment transaction, and accepts no liability for any payment processor's conduct or availability.

4.6 Team Members

Organisations may invite team members to access giv under their account and are responsible for all actions those members take.

Giver Terms

5.1 Direct Contributions

Contributions made through a Giving Page go directly to the Organisation. giv is not a party to any contribution and has no role in the transfer, custody, or settlement of funds.

5.2 Contributions are Final

Any concern about a contribution must be directed to the Organisation it was made to; giv cannot reverse, refund, or intervene.

5.3 Giver Responsibility

Giving is voluntary and made directly to the Organisation; all related matters are between the giver and the Organisation.

5.4 No Data Collection from Givers

giv does not collect personal information from givers; payment details are handled entirely by the Organisation's payment processor under that processor's own terms.

Prohibited Use

Organisations may not use giv to:

  • Host pages for illegal, fraudulent, or deceptive purposes
  • Impersonate another party
  • Violate applicable law
  • Facilitate money laundering, terrorist financing, or unlawful financial activity
  • Publish harmful or misleading content
  • Attempt unauthorised access
  • Use giv for any purpose inconsistent with its nature as online giving infrastructure

Access may be suspended or terminated for any violation.

No Financial, Legal, or Tax Involvement

giv is a software platform, and neither giv nor its developer has any involvement in the financial, legal, or tax aspects of an Organisation's giving programme. All such matters are strictly between the Organisation and the giver; independent professional advice should be sought where needed.

Service Availability

giv is provided on an "as is" and "as available" basis, with no guarantee of uninterrupted or error-free access. Access may be modified, suspended, or discontinued with reasonable notice where practicable.

Intellectual Property

All software, design, branding, and technology comprising giv remains the intellectual property of giv's developer. Organisations receive a limited, non-exclusive, non-transferable licence to use giv for the purposes in these Terms, with no right to copy, modify, redistribute, or reverse-engineer it.

Limitation of Liability

To the fullest extent permitted by law:

  • No liability for failed payments or payment processor errors
  • No liability for indirect, incidental, or consequential loss from use of giv
  • No liability for an Organisation's conduct toward its givers
  • Total liability capped at the Service Fee paid in the preceding three (3) months
  • No verification or endorsement of any Organisation's legitimacy or regulatory compliance is implied by giv or its developer through the approval process

Indemnification

Organisations agree to indemnify giv and its developer against claims, losses, or costs arising from their use of giv, content on their Giving Pages, misuse of contributions, breach of these Terms, or claims brought by a giver.

Termination

Access to giv may be suspended or terminated for breach of these Terms, non-payment, or harmful conduct. Giving Pages are deactivated on termination; prior obligations survive.

Changes to These Terms

These Terms may be updated at any time, without prior notice. Continued use of giv constitutes acceptance of the updated Terms.

Governing Law

Governed by the applicable local laws, with all disputes falling under the exclusive jurisdiction of the competent courts.
